These terms apply to your use of MyPetAway, operated by MyPetAway (“we”). By creating an account or using the service you agree to them. If you use the service for a business, you agree on behalf of that business.
MyPetAway is software. Boarding businesses use it to manage bookings, care, communication and billing; pet owners use it to deal with those businesses. We are not a party to any agreement between a business and its clients, and we don't provide, supervise or guarantee pet care. Each business is responsible for its own services, prices, policies, agreements with clients, and compliance with the laws that apply to it.
Don't use the service to:
You keep ownership of what you put into the service: pet profiles, photos, messages, records and so on. You give us permission to store, process and display it only as needed to run the service for you and the people you share it with. Businesses are responsible for having the right to record and share information about their clients.
How we handle personal information is described in our privacy policy.
Plans that include email give a business addresses at its own name on our domain. Businesses are responsible for what they send and for having a proper reason to write to the people they email. There is a daily limit on how many recipients a business can email (set by its plan), and we pause a business's sending, and may keep it paused, if many of its messages bounce or are reported as unwanted. Mail is held on our mail server on the business's behalf; we don't guarantee that every message sent or received is delivered, since that also depends on other people's mail systems. Mail programs connect with passwords created in the service, which a business should keep private and cancel when a device is lost.
We work to keep the service running and your data safe, including nightly backups, but we can't promise it will always be available or free of errors. We may change or improve features. If we discontinue the service, we will give reasonable notice and a way to export your data.
You can stop using the service at any time and ask for your account to be deleted. We may suspend or close an account that breaks these terms or puts the service or others at risk; where reasonable we will warn you first and let you export your data.
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement. Information about pets, care and health in the service is entered by owners and businesses; we don't check it, and it is not veterinary advice.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim, or US$100 if that is greater. Nothing in these terms limits liability that can't be limited by law.
If you use the service for a business, you agree to cover our reasonable costs from claims by your clients or others that arise from your services, your content, or your breach of these terms.
We may update these terms. We will change the date above and tell you in the app before significant changes take effect. Continuing to use the service after that means you accept the updated terms.
